Acceptance of Terms and Conditions
1. participating in the water activities, events, workshops, instruction, competitions, and other services provided by Wake & Surf Tourism W.L.L. ("Wake & Surf Tourism W.L.L. "), all participants ("Participants") are required to accept and comply with the following terms and conditions ("Terms"). 2. Wake & Surf Tourism W.L.L., along with its partners, managers, employees, coaches, trainers, volunteers, personnel, participants, agents, sponsors, owners/operators of the facilities, and representatives (collectively referred to as the "Company and Co"), reserve the right to refuse service to any Participant who fails to adhere to or violates these Terms.
Responsibility
1. Participants must acknowledge and agree to sign the Release of Liability, Waiver of Claims, and Indemnity Agreement provided by Wake & Surf Tourism W.L.L. before engaging in any activities. 2. The Company and Co retain the authority to deny access to the Activities if a Participant breaches or fails to comply with the Terms. 3. To participate in any activity, the minimum age is 6 years old. However, if the participant is below 18 years old, they must be accompanied by an adult.
Discipline and Inappropriate Behaviour
1. It is mandatory for all participants to adhere to the directives provided by the staff members without exception. Disregard of such instructions may lead to an instantaneous termination of the current session and ban the respective participant from all future activities. 2. Should a participant's conduct be viewed as unsuitable, Wake & Surf Tourism W.L.L. maintains the right to expel them from all activities, leaving the individual fully accountable for their own actions. 3. Unsuitable behaviour encompasses but is not limited to harming the property of Wake & Surf Tourism W.L.L., acting disruptively, and displaying any type of verbal or physical hostility towards staff and other individuals affiliated with Wake & Surf Tourism W.L.L., which includes marina personnel. 4. In the event of the Participant’s exclusion from the Activities due to the aforementioned reasons, Wake & Surf Tourism W.L. L’s responsibilities towards the Participant will terminate, and the organization will not be obliged to provide any reimbursement or compensation. 5. Wake & Surf Tourism W.L.L holds the Participant accountable for any harm caused to its property. The organization reserves the right to withhold and demand from the Participant an amount equivalent to the cost of repairs or replacement for any damages incurred due to the aforementioned behaviour.
Obligation
1. To participate in the Session, the Participant must possess the ability to swim independently and wear a life vest throughout the duration of the activity. 2. The duration of each Session must be a minimum of 60 minutes from the point of departure until the return to the dock, and the Participant should be present at the assigned berth 15 minutes prior to the start time. 3. In the event of a delayed session start due to the Participant's tardiness, the missed time will be subtracted from the assigned Session. 4. Each Session shall conclude at the designated time without any exceptions. Cancellation or no-show of a booked Session by the Participant due to weather conditions will not result in any refund or compensation. 5. Wake & Surf Tourism W.L.L will operate in all weather conditions; however, in rare circumstances where the weather is deemed hazardous by Wake & Surf Tourism W.L.L, the activities will be stopped. In such odd circumstances, the Session will be rescheduled, and the Participant will receive a voucher for their next session.
Price and Payment
1. The prices provided comprise all necessary equipment, including boats, wakeboards, wakesurf boards, ropes, wetsuits, and helmets. 2. Prior to partaking in the Activities or Sessions, Participants must pay the predetermined fee. Lack of payment before the Session's commencement may result in the Participant's reservation and Session cancellation without notice, denying the Participant access to the Session. 3. Participants can purchase a voucher from Wake & Surf Tourism W.L.L applicable to multiple Sessions. The code received by email is redeemable to book the designated timeslot through the website before the commencement of the Activities or Session. The voucher given cannot be reimbursed or replaced for cash and is non-refundable in part or full.
Cancellation Policy and Refund
1. Wake & Surf Tourism W.L.L maintains the right to call off or reschedule a Participant's booking at any moment before the Session's commencement. Should it be necessary to do so, Wake & Surf Tourism W.L.L tourism will reimburse the fees paid for that Session by means of a voucher for the next Session. 2. The Participant can reschedule 24 hours preceding the scheduled Session by informing Wake & Surf Tourism W.L.L via WhatsApp or phone, listed below. 3. In such instances, the Participant will be granted a refund in the form of a voucher for the next Session. Should the Participant cancel their Session fewer than 24 hours ahead of the scheduled time or be absent from the booked Session, no compensation or refund of any sort will be available for the Participant to claim. 4. Wake & Surf Tourism W.L.L will only provide vouchers as a refund in all circumstances and will not provide cash or similar reimbursement. Vouchers are usable as payment towards future bookings as per the original booking in full.
Health and Safety
1. Before commencement of the Activities, it is essential for the Participant to notify both the Company and Co of any medical conditions or injuries they may have. 2. The Participant's safety and health remain their sole responsibility.
Jurisdiction
1. These Terms are governed by Qatari Law, and any dispute, controversy, or claim arising from or related to them will be settled conclusively before the courts of the State of Qatar.
Miscellaneous
1. It is the responsibility of Participants to provide their own personal items such as drinking water, towels, sun protection, and any other necessary items, unless the participant orders drinks or snacks add-ons through the website. 2. Wake & Surf Tourism W.L.L will not supply such items. The Terms, along with the Release of Liability, Waiver of Claims and Indemnity Agreement, and Private and Cookies Policy form a complete agreement between the Participant and Wake & Surf Tourism W.L.L. 3. Any changes or additions to these Terms are not valid unless approved in written form by Wake & Surf Tourism W.L.L.
